Terms of use

The agreement between you and Yammak when you use the rider app, the driver app and the drivers’ application site: what Yammak provides, what each side undertakes, the limits of liability, and how disputes are settled. In force from 21 September 2026.

Who we are

Yammak is a service run by Alhareth Ali Jasim Al-mashhadani as a sole trader, in Baghdad, Iraq; he is the party you contract with when you accept these terms. Contact: [email protected].

These terms apply to the rider app, the driver app and the drivers’ application site, and to every trip requested or booked through them. Our privacy policy completes them.

Accepting these terms, and contracting electronically

You accept these terms when you create your account or use the service, and that acceptance is a valid contract between us: Article 18 of the Electronic Signature and Electronic Transactions Law No. 78 of 2012 allows offer and acceptance by electronic means, and Article 13 of that law gives the electronic record its force as evidence. We keep an electronic record of your account, your requests and your trips.

When you request a ride and a driver accepts it, or you book a seat, an agreement for carriage is made between you and the driver, at the fare the app showed you before you confirmed.

Who may use Yammak

You must have reached eighteen — the age of majority under Article 106 of Civil Code No. 40 of 1951 — and be able to enter into a contract. Do not open an account for anyone younger.

To drive with Yammak you must hold a valid driving licence, the car you register must be registered in your name or be one you are allowed to drive, your documents must stay in date, and our team must approve your application.

Your account

One person, one account. Do not open a second account, use someone else’s, or let anyone else use yours. You sign in with Google, with Apple, or with your email and a password; you must give accurate details and keep your password secret.

You are responsible for what is done through your account by you, by anyone you let use it, or because you did not keep it safe. If you think someone else has got into your account, tell us at once; you are not answerable for what is done through it after you told us, as long as you were not at fault.

You can delete your account whenever you like, from inside the app or by asking us; the Delete your account page explains how.

Yammak’s role

Yammak is an electronic platform that connects riders with drivers who work for themselves, in their own cars. The app offers your request to nearby online drivers, works out the fare for a city ride, lets you book seats on trips between cities or hire a whole car, keeps the trip record and provides the safety features. The carrying itself is done by the driver: the driver is the carrier, bound to bring you safely to your destination under Transport Law No. 80 of 1983, and the agreement for carriage is made directly between you and the driver; Yammak does not make it in its own name.

That does not mean Yammak answers for nothing. It is responsible for its service, and for its own fault and the fault of those who work for it, and you keep against it every right that Consumer Protection Law No. 1 of 2010 gives you — a law that treats an intermediary in providing a service as a supplier.

The driver works for themselves: they choose when to go online and take requests, drive their own car, take the fare from the rider directly, and bear the costs of their car and whatever taxes and fees their work incurs. These terms create no employment relationship between the driver and Yammak.

Needs legal review: Not yet settled: Yammak’s position on the Ministry of Transport’s licence for mobile taxi offices and on the Communications and Media Commission’s licence for on-demand platforms (or an exemption from it); which vehicle registration category drivers must be required to hold; and whether fares need an approved tariff. This needs a legal decision before publication.

What riders undertake

To set the pickup and destination accurately, to be ready when your driver arrives, and to pay your driver, in cash, the fare the app showed you.

To follow the safety instructions your driver gives you, to treat the driver and the car with respect, and to look after the belongings you keep with you: you answer for any harm your belongings cause, and the driver answers for losing them only if the driver was at fault (Articles 18 and 19 of the Transport Law).

On trips between cities: to be at the garage on time, to give the driver the boarding code shown on your screen so they can record that you are on board, and not to book seats you do not mean to use.

What drivers undertake

To keep your details and documents true and in date; to hold everything the law requires to carry passengers for a fee, including what Traffic Law No. 8 of 2019 and the Ministry of Transport’s rules require; and to bear yourself any fine or penalty for breaking them.

To drive safely and obey the traffic rules, to carry the rider to their destination in the car registered on your account, not to carry more passengers than the car is licensed for, and not to ask for more than the fare the app showed.

To record each rider’s boarding on trips between cities with their boarding code; to stop somewhere safe and end the trip if a rider asks to get out; and to hand in anything a rider leaves in your car, as the Traffic Law requires.

Not to use a rider’s name, address or messages for anything but completing the trip, nor keep or publish them: disclosing what you learn through your work is punishable under the Penal Code (Article 437).

To confirm and undertake that your driving licence is valid; that the car registered on your account carries a for-hire registration («أجرة») that allows carrying passengers for a fee, not a private one («خصوصي») (Article 25 of Traffic Law No. 8 of 2019); and that you hold every other licence or permit the law requires for it. Meeting this is your own responsibility, and we may suspend or close your account if it turns out you do not hold what the law requires.

Fares and payment

A city ride’s fare is worked out automatically when you request it, from the estimated distance and time at prices we set, and you see it before you confirm. On trips between cities the driver sets each seat’s price when posting the trip, within limits we set; a whole car costs the price the driver offered and you chose.

Today you pay the fare in cash, directly to the driver: Yammak takes no money from you and charges you no service fee. If our prices change, the price of a trip already shown to you does not.

A city ride’s fare does not change after you request it, except in one case: you ask to get out before your destination (see Safe Stop below).

Cancelling

You can cancel a city ride, or the hire of a whole car, from the app until the trip starts; and cancel a seat on a trip between cities until boarding starts — unless riders’ contributions have already paid for the whole car, in which case the seat can no longer be cancelled. We charge no cancellation fee today.

A driver may withdraw from a trip before it starts; the app shows you when that happens, and you pay nothing for a trip that did not start. We may also find no driver for your request, and the app tells you so.

Safe Stop

On city rides only, while the ride is under way, if you want to get out before your destination, ask to stop from the app: your request reaches the driver at once, so they can pull over somewhere safe and end the ride. After a short wait the app counts down for you, you can record that you have got out; you are then released from the ride and can request another car.

Your fare is then worked out from the distance the car’s recorded route shows you travelled, between the city minimum and the price you agreed to; if the route was not recorded without gaps, the agreed price stands. Safe Stop is not an emergency service: in danger, call the police on 104 or an ambulance on 122.

Seats between cities, and hiring a whole car

A driver posts a trip between two cities: the time, the stations, the number of seats and their price. You book one seat or more, and you get a four-digit boarding code that no one else sees. Before boarding starts, you may contribute toward the price of the empty seats, and the driver may change the price of seats not yet booked, within the same limits.

The car does not leave until its price is covered by seats booked and contributions, unless the driver chooses to leave with empty seats and bear the shortfall. Once boarding starts, nothing changes what you pay. What you pay is your seats’ price plus your contribution, less your share of any contribution the car turned out not to need; you pay it to the driver in cash.

You can also hire a whole car for a trip between cities: you post your request, drivers offer you their prices within limits we set, and you choose one; that price is the fare.

Commission, subscriptions and the credit limit

Yammak does not collect the fare; the driver receives it from the rider. If our team puts you on a plan, it is either a commission on each completed trip, recorded on your account automatically, or a fixed weekly or monthly subscription. We tell you your plan and its amount before it applies to you.

What you owe builds up on your account with us, and you settle it in cash with our team, who record it; you then get a notice with the amount. No entry on your account is edited once recorded; any correction is recorded as an opposing entry.

If a credit limit applies to you and what you owe passes it, you cannot go online to take requests until you settle at least the amount over the limit; the app shows you both figures. This never stops you finishing a trip you have started.

What is not allowed

No one may give false details or documents; open more than one account or use someone else’s; insult, threaten, harass or discriminate against the other person; carry anything the law forbids; cheat on a fare or create fake trips; or tamper with the apps or our servers, or try to reach other people’s data.

No one may publish the other person’s photo or anything from their private life without their permission (Article 438 of the Penal Code), or use the chat for anything but the trip.

After a city ride or a private hire, either side — rider or driver — may ask never to be matched with the other again, and we honour that quietly. This does not apply to shared seats on trips between cities.

Suspension and closing an account

You may stop using Yammak and delete your account at any time. After a review by a person, our team may refuse a driver’s application, or suspend a driver’s account, if their documents do not meet the requirements or they break these terms; we tell them why. A driver automatically stops receiving requests when their licence or the car’s registration expires, until they upload a new one and our team approves it.

We may close any account that seriously breaks these terms, or where the law requires it. You can object to any decision by writing to us. Suspending or closing an account does not cancel rights and obligations that arose before it, such as the fare of a trip already made or an amount a driver owes.

Limits of liability

Yammak is responsible for its service — the apps working, offering requests, working out fares, keeping records and the safety features it provides — and for its own fault and the fault of those who work for it. Driving, the car’s condition and bringing the rider safely to their destination are the driver’s responsibility as the carrier, and no agreement can release the driver from it (Article 10 of Transport Law No. 80 of 1983).

We do not guarantee that you will always find a driver, or that the app will work without interruption or error: a request may end with no driver found, a notification may be late, a location may drop. Apart from fraud and gross fault, we answer only for direct harm that was normally foreseeable when the contract was made (Article 169 of the Civil Code).

Nothing in these terms releases Yammak or the driver from liability for fraud or gross fault (Article 259 of the Civil Code), or for a harmful act, including harm to a person’s life or body; and nothing in them reduces any right that the Consumer Protection Law, or any other law that cannot be contracted out of, gives you.

Making good harm you cause

If Yammak suffers harm because you broke these terms or the law — such as a fine imposed on us, or compensation claimed from us, because of what you did — you must make it good, to the extent it is shown to result from what you did, under the rules of liability in the Civil Code.

Governing law and courts

These terms, and every agreement for carriage made through Yammak, are governed by Iraqi law. The courts of Baghdad have jurisdiction over any dispute arising from them, a choice that Article 37 of Civil Procedure Law No. 83 of 1969 allows; this does not stop you bringing your claim before any other court that law makes competent, such as the court of the place where the obligation arose or was performed.

Before going to court, please write to us so we can try to settle the matter amicably; you can also complain to the Consumer Protection Council. These terms contain no agreement to arbitrate.

Changes to these terms

We may change these terms when what Yammak provides, or what the law requires, changes. We publish the new text here with the date it takes effect, and announce any significant change in the app before it takes effect. No change applies to a trip requested or booked before it.

If you keep using Yammak after a change takes effect, you have accepted it; if you do not accept it, you can stop and delete your account. This version is in force from 21 September 2026.

The language of these terms

The Arabic text of these terms is the authoritative one; the English and Kurdish texts are translations of it. If they differ, the Arabic text prevails.
